Proactiv Perks Rewards Program Terms and Conditions

Proactiv customers in the United States may join the Proativ Perks rewards program and earn points by making purchases on proactiv.com and by engaging in other activities, as set forth below. Once a participant accumulates 2,000 points, the points can be converted into a $10 reward. These Terms and Conditions (these "Terms") govern your participation in Proactiv Perks. Please read them carefully. By enrolling in the program, you agree to these Terms and the Proactiv website Terms and Conditions (the "Agreement"), which are incorporated by reference.

PLEASE NOTE THAT SECTION 14 OF THE AGREEMENT INCLUDES A MANDATORY ARBITRATION AGREEMENT, WHICH MEANS THAT YOU AGREE TO SUBMIT ANY CLAIM (DEFINED IN SECTION 14 OF THE AGREEMENT) TO BINDING INDIVIDUAL ARBITRATION, RATHER THAN PROCEEDING IN COURT.

  1. ELIGIBILITY

    Participation is open to any customer in the United States who has a proactiv account. Employees of The Proactiv Company, LLC, and its affiliates are eligible for participation . Enrollment is nontransferable. The Proactiv Perks rewards program is void where prohibited by law.

  2. ENROLLMENT

    Existing customers with a proactiv account may enroll in Proactiv Perks by going to www.proactiv.com/member-dashboard. New customers can enroll in Proactiv Perks on the order summary page at checkout. To enroll, customers will have to fill in all mandatory information on the enrollment form – including name, physical address, and email address or a mobile phone number – and check the box indicating they accept these Terms. By enrolling, you agree to our contacting you for the purposes of providing you with information and updates related to the Proactiv Perks rewards program.

  3. EARNING POINTS

    Proactiv Perks participants earn 10 points per every $1 spent on proactiv product subscriptions and purchases in the www.proactiv.com product catalog. Points are not earned on any portion less than $1, such as $0.50. Purchases made at independent retail outlets that carry proactiv products are currently not eligible to earn points. Point calculations are based upon dollars spent at checkout on product purchases. Points are not earned on any dollars spent on sales tax, or shipping and handling. Participants do not earn points for the amount of any rewards redeemed or discounts applied to an eligible or qualifying product purchase. Participants must be logged into their online proactiv account to be eligible to earn points on purchases. The number of points earned is based on the final purchase amount of all items in a single transaction. Purchases made prior to enrollment in the program are not eligible to earn points. Earned points will be updated to a participant’s account at or before shipment of their purchase.

  4. Refer a Friend

    Participants can earn points by referring friends to protactiv.com. Participants can refer friends by accessing their Perks dashboard at www.proactiv.com/perks and following the instructions to send their friends a message which will include the referring participant’s unique link and a $10 coupon. The friend may use the coupon on any purchase on protactiv.com that totals at least $35 before taxes, shipping, and the coupon are applied. Coupons expire within 30 days of issuance. The referring participant will only get points if (a) the referred friend is a new proactiv customer, (b) the friend uses the referring participant’s unique link within 30 days, and (c) the friend makes an eligible purchase. Proactiv will specify the number of points that a participant can earn by referring a friend on the Perks dashboard. Proactiv may change the number of points that may be earned by referring friends at any time.

  5. BONUS POINTS

    At certain times, proactiv may offer promotions in which participants may earn additional or "bonus points" in connection with the purchase of certain products, reaching certain spending amounts in one purchase, participating in specified events, referring friends, or taking other certain actions. During these promotions, a participant will earn the bonus points as specified in the specific offer. Bonus point promotions are subject to the terms and conditions of the offer and may be offered at any time at proactiv’s sole discretion. Bonus point promotions are valid for a limited time only and may be ended without notice.

  6. BENEFITS

    Proactiv Perks loyalty program participants receive:

    • $10 off reward (coupon) every time you reach 2,000 points
    • Special surprises throughout the year
    • Opportunities to earn bonus points when advertised to participants

    In most cases, points will be posted to a participant’s account upon or before shipment of their purchases. If connectivity is disrupted, the points will be posted when the systems are back online.

  7. POINTS BALANCES

    Participants are responsible for ensuring that the point balance in their account is correct. If you believe that you did not receive points or that there is some other error in your account, you must contact us by sending a detailed email to perks@proactiv.com within 30 days of the date you expected to earn the points. We will investigate any issues, but proactiv’s good faith determination of the amount of points earned by any participant shall be final and binding.

  8. REDEEMING POINTS

    Once a participant has accumulated 2,000 points, the points can be redeemed for a $10 reward. This is done in the participant’s Proactiv Perks profile – www.proactiv.com/perks-dashboard. To redeem a reward, a participant enters the code on the reward certificate into the promotion code box at checkout. There is no minimum purchase required to redeem the reward, but no "chage back" or credit is given for a partially used reward (i.e., if the purchase total is less than the reward value). Rewards may only be redeemed at www.proactiv.com. Points can be used on any product purchase but at this time, cannot be used for subscription orders that are billed monthly. If a participant has a point balance greater than 2,000, they can redeem their points for a $10 reward for each 2,000-point increment. Any remaining balance is rolled forward. Rewards cannot be redeemed on the same transaction where they were earned. Only one coupon code can be redeemed in checkout at a time. There is no limit to how many points or how many rewards a participant can earn in one year.

  9. VALUE AND TRANSFERABILITY

    Points and rewards have no cash value, are issued for promotional purposes only, are nontransferable, cannot be bartered, exchanged or redeemed for cash, do not constitute property of the participant, may not be combined among participants and may not be transferred or assigned to any other person, entity, trust or estate.

  10. EXPIRATION

    Points expire two years from the issue date. Rewards expire 365 days from the issue date, which is shown on the rewards certificate. Once points are converted to a reward, they are removed from a participant’s point balance and do not count toward future rewards. Participant accounts are considered dormant after no activity for three years and may be cancelled.

  11. RETURNS

    Proactiv reserves the right to deduct points from a participant’s account if a participant earned points from a purchase and that purchase is later subject to a return, refund or other credit.

  12. UPDATES TO PARTICIPANT INFORMATION

    Participants may update their account profile information on the Proactiv website www.proactiv.com/myaccount. The information you provide is subject to proactiv’s Privacy Policy, which can be found at https://www.proactiv.com/privacy-policy.

  13. PARTICIPANT CANCELLATION

    Participants may cancel their Proactiv Perks rewards program membership at any time by sending an email to perks@proactiv.com. Upon account cancellation or closure, any unused points accrued in your account or rewards earned will be forfeited and cancelled, and cannot be redeemed.

  14. CHANGES TO TERMS

    Proactiv reserves the right to, in its sole discretion, to modify any part of these Terms – including, but not limited to, the rules for earning points, the thresholds needed to earn rewards, the expiration of points or rewards, or any other requirements – without notice, even those such modifications may affect the benefits that a participant has already accumulated. In addition, proactive reserves the right to terminate the Proactiv Perks program at any time.

  15. GENERAL

    Abuse of the Proactiv Perks program may result in our taking any action we deem appropriate, including without limitation, issuing a warning, suspending or terminating your access to and use of the program, and canceling any unused rewards. Abuse includes but is not limited to: failure to follow these Terms; making purchases for resale; the sale or barter of rewards, points or promotional offers; and any misrepresentation of fact or other improper conduct as determined by proactiv in its sole judgment. Proactiv reserves the right to take appropriate legal action to recover damages, attorneys’ fees and court costs arising out of the enforcement of any of these Terms.

    In accumulating points, participants may not rely on the continued availability of any reward, and they have no vested right with respect to points, rewards or program benefits. Proactiv Perks loyalty program points and rewards may be subject to tax liability. Any tax liability is the responsibility of the participant. This program is void where prohibited by law.

    We collect Personal Information about you via our Website when you provide it through various forms and places on the Website such as in connection with a request for a product, service, or information or if you register for a Website account. In general, you may browse our Website without providing any Personal Information; however, if, for example, you decide to place an order, we will ask you for Personal Information such as your name, delivery and billing address, phone number(s), email address, credit card number and its expiration date. If you choose to complete a user registration form, survey, sweepstakes or contest entry form, we may ask you for information such as your contact information (e.g., name, e-mail address and mailing address), age group or birth date.     Personal Information Collected Automatically

    We may also use tracking technologies (as described below) in order to automatically (or passively) collect, store or accumulate certain information concerning your use of this Website, such as information regarding which of our pages are most popular, your IP address, UDID or other unique identifier, browser type such as Internet Explorer®, Safari®, Chrome®, etc., city, time zone, referring URL, and operating system such as Windows®, Mac®, iOS® or Android®. However, if the parent or guardian of a child under 13 believes that the child has provided us with personally identifiable information, the parent or guardian of that child should contact us at privacy@proactiv.com if they want this information deleted from our files so that it is not in retrievable form. If we otherwise obtain knowledge that we have personally identifiable information about a child under 13 in retrievable form in our files, we will delete that information from our existing files so that it is not retrievable.

  2. Use/Disclosure of Personal Information

    The Company and its affiliates and subsidiaries may use the Personal Information that you provide for business purposes, such as to fulfill your request for a product, information, or other service, or respond to an email or other request, as well as for commercial purposes such as to create and deliver to you our newsletters or surveys, email and postal mail marketing communications containing product information, usage tips or promotions, help improve our Website or services, or customize visitors' experience at our Website. The Company may also make certain Personal Information (e.g., your name, email address, mailing address and/or telephone number) available to carefully selected business partners, vendors and other third party organizations to provide you with information about products, services and special offers we think may interest you or to improve our products, services and advertising. Many of our users find this a valuable and time-saving service.

    We want to communicate with you via email and/or postal mail correspondence only if you want to hear from us.     We may contract with third party companies or individuals to provide certain services for business purposes including email and hosting services, credit card processing, shipping, data management, surveys and marketing, promotional services, to assist in preventing or deterring fraud, etc. We call them our "Service Providers." We may share Personal Information with Service Providers solely as appropriate for them to perform their functions, but they may not use such information for any other purpose.
